|WHAT IS MEDIATION?
Mediation is a non-adversarial interpersonal process, in which the parties to a dispute are supported by a neutral third party (the certified mediator) in identifying the disputed issues, developing options and seeking their own fair settlement. As a neutral party, the mediator has no advisory or decision-making authority and functions solely as a facilitator.
|HOW DOES IT WORK?
The parties and mediator meet at a mutually convenient time to discuss the nature of the conflict and to facilitate decision making in an atmosphere of calm, sometimes conversing as individuals and sometimes together. The mediator supports the parties in moving from hard and fast positions to areas of common interest where joint problem-solving can occur, ultimately creating an agreement forged from their own resolution. This final "Agreement", if reached, is binding and enforceable, as the parties so chose.
